Course outline
Compensation is the most common remedy in employment claims and understanding the principles that apply in tribunal awards is critical for all advisers.
This course looks at the main principles used in compensation claims, how to construct and challenge schedules of loss and at the evidence needed to support arguments on compensation. Participants will refresh basic skills in calculating losses and apply them to a series of challenging case studies allowing you to apply them to you work as soon as possible.
The course will also look at the various ways of dealing with the settlement of tribunal cases so that a legally enforceable agreement is reached.
This course will deal with:
- the definition of a week’s pay for statutory awards
- unfair dismissal compensation – basic and compensatory awards – adjustments and deductions to compensation
- discrimination awards – injury to feelings and financial loss
- interest on discrimination awards
- mitigation of loss arguments
- assessment of future loss
- pension loss
- drafting a schedule of loss
- evidence to support or challenge schedules of loss
- methods of settlement – COT3 – compromise agreements – Tomlin orders
Learning objectives
By the end of this course you will have learnt how to:
- draft a comprehensive schedule of loss in an unfair dismissal and discrimination cases
- put forward arguments to support compensation claims
- explain when and how ‘Polkey’ arguments might be made in a case
- assess injury to feelings awards in discrimination claims
- correctly calculate interest in discrimination cases
- draft terms of settlement
