Course outline
The settlement of employment disputes has always required the use of negotiation but often the skills required to achieve the best result for the client are not fully developed or understood.
It is also clear from the Gibbons Review of Employment Dispute Resolution in 2007 which recommended greatly increased use of mediation and early dispute resolution in employment disputes that negotiation skills are going to be a key area for progressive advisers.
This course aims to inform you of the key elements in negotiation and the leading research on use of these skills to achieve better negotiations and outcomes for your clients.
Our tutors have many years experience in dealing with negotiations and settlement of tribunal claims. They also have experience of participating in the pilot of judicial mediation of discrimination claims in Employment Tribunal underway in some tribunals. They will pass on their experience and tips along with explaining how to deal with the common tactics you will find used against you.
Learning objectives
By the end of this course you will have learnt how to:
- identify the main negotiation styles and their common features
- spot common tactics used in negotiation and how to respond to them
- use the concepts of principled negotiation for better outcomes
- plan for a successful negotiated outcome to an employment dispute
- explain what a BATNA is and how to use it
- describe mediation and its benefits to your client
- employ negotiation principles in a mediation
