The course covers employment rights that are of specific interest to young workers:
- Status, including employee or worker, trainees, apprenticeships – Employment Rights Act, Dacas v Brook Street Bureau, Flett v Matheson
- The composition of the employment contract – express, implied, written, oral terms
- Wages – Employment Rights Act S13-27, National Minimum Wage Regs 1999
- Statutory Rights: - Employment Right Act 1996, Working Time Regs 1998, Health and Safety at Work Act 1974, Inland Revenue v Ainsworth
- Privacy and data protection – Data Protection Act 1998, Monitoring at Work Regs
- Discrimination issues - sex - race - age - disability – Employment Equality Regulations
- Remedies
Learning Objectives:
At the end of the course participants should be able to:
- Identify the different types of employment status and how this affects rights in the workplace
- Understand statutory protection under the employment contract
- Recognise rights under the National Minimum Wage Regulations and the Working Time Regulations
- Recognise the different types of discrimination and how these may be encountered in the workplace
- Understand the legal parameters of office surveillance
- Know how to correct inaccurate employment records
- Know how employment rights may be enforced
