Although immigration status in general is covered, the course concentrates on problems encountered by workers from the A8 nations.
The course covers:
- Immigration status and the right to work – Worker Registration Scheme
- Work permits and the Highly Skilled Migrant Workers programme – Asylum and Immigration Act 1996 S8
- Contractual and Status problems – Employment Rights Act 1996, Dacas v Brook Street Bureau, Wheeler v Quality Deep Ltd
- Statutory Rights – Working Time Regs, National Minimum Wage Regs
- Discrimination – Race Relations Act 1976, Employment Equality Regs 2003
- Welfare Benefits – EEC Reg 1612/68, EEC Reg 1251/70
- Enforcement of Rights
Learning Objectives:
At the end of the course participants should be able to:
- Identify the different types of immigration status and how this affects rights in the workplace
- Understand the issues surrounding the status of agency workers
- Understand statutory protection under the employment contract
- Recognise rights under the National Minimum Wage Regulations and the Working Time Regulations
- Understand the different types of discrimination and how these may be encountered in the workplace
- Understand what benefits are available for different categories of migrant workers
- Know how employment rights may be enforced
