Course outline
The employment rights issues involved when a business transfers to another owner are among the most complex cases in employment law.
This course aims to give a clear understanding of the basic principles involved in this situation and the legal rights created by the, recently updated, Transfer of Undertakings (Protection of Employment) Regulations 2006. Participants will apply these principles in a range of cases studies to study the normal application of these rules and the problems that also arise.
The course will cover:
- what constitutes a relevant transfer of an undertaking
- how TUPE applies to contracting in and out
- how transfers affect terms and conditions of employment
- remedies for dismissals related to transfers
- ‘ETO’ defences to dismissals and contract changes
- how TUPE operates when a business is insolvent
- consultation duties on parties to a transfer
Learning objectives
If you come on this course you will learn to:
- recognise when a TUPE transfer occurs
- explain the liabilities and responsibilities that employers have in a transfer situation
- analyse ETO defences put forward by parties to a transfer
- advise a client on their remedies if they are dismissed for a reason related to a TUPE transfer
