E01 Introduction to employment law

The course includes

  • Formation of the employment relationship – express and implied terms - continuity of employment – variation of contracts
  • Status of employees – employees – workers – agency workers – Dacas v Brook Street
  • Trade Union Rights
  • Rights in the workplace – contractual and statutory – focus on Working Time Regulations and “Family Friendly” Rights
  • Discrimination in the workplace
  • Grievance Procedures
  • Termination of the contract – notice – wrongful and unfair dismissal
  • Redundancy
  • Disciplinary and Dismissal Procedures
  • Employment Tribunal Procedure

Participants will explore these topics in a series of short lectures and directed case studies to give practical examples of the issues that arise in the employment relationship.

Learning objectives

At the end of the course participants should be able to:

  • Analyse what type of employment relationship is formed in given circumstances
  • Describe the main employment rights
  • Understand when employment relationships are unlawfully terminated
  • Advise on the main steps in employment tribunal procedure

Full materials will be provided including guidance on resources and development.
